Nez\u00e1le\u017e\u00ed pritom, \u010di ide o oblek, z\u00e1steru, mont\u00e9rky alebo biely laborat\u00f3rny pl\u00e1\u0161\u0165. Na \u010dom v\u0161ak z\u00e1le\u017e\u00ed je to, \u010di svojim zamestnancom pracovn\u00e9 oble\u010denie poskytne zamestn\u00e1vate\u013e, alebo si ich musia zadov\u00e1\u017ei\u0165 sami. Toto je forma pracovn\u00e9ho oble\u010denia, ktor\u00fa v\u00e1m <strong>zamestn\u00e1vate\u013e zvy\u010dajne neposkytne <\/strong>a nepatr\u00ed ani medzi osobn\u00e9 ochrann\u00e9 pracovn\u00e9 prostriedky.<\/p>\r\n\r\n\r\n\r\n<p>Minim\u00e1lne po\u017eiadavky na <strong>poskytovanie a pou\u017e\u00edvanie osobn\u00fdch ochrann\u00fdch pracovn\u00fdch prostriedkov (OOPP<\/strong>), medzi ktor\u00e9 rad\u00edme aj <a href=\"https:\/\/www.gajos.sk\/eshop\/kategoria\/odevy\/\">pracovn\u00e9 oble\u010denie<\/a> a <a href=\"https:\/\/www.gajos.sk\/eshop\/kategoria\/obuv\/\">pracovn\u00fa obuv<\/a>, upravuje Nariadenie vl\u00e1dy <a href=\"https:\/\/www.uvzsr.sk\/docs\/leg\/395_2006.pdf\" rel=\"nofollow noopener\" target=\"_blank\">\u010d. 395\/2006 Z.z<\/a>.\u00a0\u00a0\u00a0<\/p>\r\n\r\n\r\n\r\n<p>Pod\u013ea neho patr\u00ed medzi <a href=\"https:\/\/www.gajos.sk\/eshop\/kategoria\/ochranne-pomocky\/\">OOPP<\/a> ka\u017ed\u00fd prostriedok, ktor\u00fd zamestnanec pri pr\u00e1ci <strong>nos\u00ed, dr\u017e\u00ed alebo inak pou\u017e\u00edva (vr\u00e1tane jeho doplnkov a pr\u00edslu\u0161enstva), ak je ur\u010den\u00fd na ochranu bezpe\u010dnosti a zdravia zamestnanca.<\/strong> Medzi osobn\u00e9 ochrann\u00e9 pracovn\u00e9 prostriedky na ochranu zdravia a \u017eivota pri pr\u00e1ci patria:<\/p>\r\n\r\n\r\n\r\n<ul class=\"wp-block-list\">\r\n<li>ochrann\u00e9 pracovn\u00e9 odevy,\u00a0<\/li>\r\n<li>pracovn\u00e1 a bezpe\u010dnostn\u00e1 obuv,\u00a0<\/li>\r\n<li>pracovn\u00e9 rukavice,\u00a0<\/li>\r\n<li>ochrann\u00e9 pracovn\u00e9 prilby, sl\u00fachadl\u00e1 a in\u00e9 chr\u00e1ni\u010de sluchu,\u00a0<\/li>\r\n<li>prostriedky na ochranu d\u00fdchania (filtre a respir\u00e1tory),\u00a0<\/li>\r\n<li>ochrann\u00e9 okuliare, \u0161t\u00edty a kukly,\u00a0<\/li>\r\n<li>prostriedky na prevenciu proti p\u00e1du a pr\u00e1cu vo v\u00fd\u0161kach.\u00a0<\/li>\r\n<\/ul>\r\n\r\n\r\n\r\n<h4 class=\"wp-block-heading\">Ak\u00e9 kateg\u00f3rie pracovn\u00fdch odevov pozn\u00e1me?<\/h4>\r\n\r\n\r\n\r\n<p>Ak sa na pracovn\u00fd odev pozrieme bli\u017e\u0161ie, rozli\u0161ujeme <strong>tri hlavn\u00e9 kateg\u00f3rie<\/strong> pracovn\u00e9ho oble\u010denia:<\/p>\r\n\r\n\r\n\r\n<p><strong>1. Povinn\u00fd ochrann\u00fd pracovn\u00fd odev a obuv<\/strong><\/p>\r\n\r\n\r\n\r\n<p>Sl\u00fa\u017ei najm\u00e4 na <strong>zaistenie bezpe\u010dnosti a ochrany zdravia<\/strong> zamestnanca pri pr\u00e1ci. Pou\u017e\u00edvame ich vtedy, ak nebezpe\u010denstvo nemo\u017eno vyl\u00fa\u010di\u0165 ani obmedzi\u0165 technick\u00fdmi prostriedkami, prostriedkami kolekt\u00edvnej ochrany \u010di in\u00fdmi formami.\u00a0<\/p>\r\n\r\n\r\n\r\n<p>Zamestn\u00e1vate\u013e mus\u00ed tieto OOPP <strong>poskytn\u00fa\u0165 automaticky<\/strong> bez toho, aby o ne musel zamestnanec \u017eiada\u0165. Pr\u00edloha \u010d. 3 v u\u017e spom\u00ednanom Nariaden\u00ed vl\u00e1dy uv\u00e1dza <strong>zoznam pr\u00e1c<\/strong>, pri ktor\u00fdch zamestn\u00e1vate\u013e pride\u013euje a poskytuje osobn\u00e9 ochrann\u00e9 pracovn\u00e9 prostriedky automaticky. Zoznam nie je \u00fapln\u00fd a <strong>m\u00f4\u017eu existova\u0165 a postupne prib\u00fada\u0165 <\/strong>aj in\u00e9 druhy pr\u00e1c, pri ktor\u00fdch m\u00e1 na OOPP zamestnanec n\u00e1rok.<\/p>\r\n\r\n\r\n\r\n<p><strong>2. Be\u017en\u00fd pracovn\u00fd odev a obuv, ktor\u00e9 podliehaj\u00fa mimoriadnemu opotrebovaniu alebo zne\u010disteniu<\/strong><\/p>\r\n\r\n\r\n\r\n<p>Tento druh pracovn\u00e9ho oble\u010denia a obuvi<strong> nie je potrebn\u00fd<\/strong> na zaistenie bezpe\u010dnosti a ochrany zdravia zamestnanca. Aj tu plat\u00ed n\u00e1rok zamestnanca v pr\u00edpade, ak konkr\u00e9tny odev a obuv podlieha mimoriadnemu opotrebovaniu alebo zne\u010disteniu. Za mimoriadne opotrebenie alebo zne\u010distenie pova\u017eujeme stav, ke\u010f sa pracovn\u00fd odev a obuv stan\u00fa nepou\u017eite\u013en\u00fdmi a nevhodn\u00fdmi na pr\u00e1cu <strong>za menej ako \u0161es\u0165 mesiacov.<\/strong><\/p>\r\n\r\n\r\n\r\n<p><strong>3. Be\u017en\u00fd pracovn\u00fd odev a obuv, ktor\u00e9 nepodliehaj\u00fa mimoriadnemu opotrebovaniu alebo zne\u010disteniu<\/strong><\/p>\r\n\r\n\r\n\r\n<p>Ide o be\u017en\u00e9 \u201emana\u017e\u00e9rske\u201c pracovn\u00e9 oble\u010denie (oblek, kravata, bl\u00fazka, suk\u0148a a pod.) Tieto pracovn\u00e9 odevy <strong>nie s\u00fa pri pr\u00e1ci mimoriadne opotrebov\u00e1van\u00e9<\/strong>, preto zamestn\u00e1vate\u013e <strong>nie je povinn\u00fd<\/strong> ich zamestnancovi poskytova\u0165. Be\u017en\u00fd pracovn\u00fd odev (profesie v administrat\u00edve), uniforma s obuvou (lek\u00e1ri, zdravotn\u00e9 sestry), prostriedky pou\u017e\u00edvan\u00e9 pre cestnej doprave (vodi\u010d a reflexn\u00e1 vesta) alebo \u0161portov\u00fd v\u00fdstroj <strong>nie s\u00fa pova\u017eovan\u00e9 za osobn\u00e9 ochrann\u00e9 prostriedky.<\/strong><\/p>\r\n\r\n\r\n\r\n<h4 class=\"wp-block-heading\">Kedy m\u00e1 zamestnanec n\u00e1rok na bezplatn\u00e9 poskytnutie OOPP?<\/h4>\r\n\r\n\r\n\r\n<p>Zamestn\u00e1vate\u013e je zo z\u00e1kona povinn\u00fd <strong>neust\u00e1le vyhodnocova\u0165 riziko<\/strong> spojen\u00e9 s vykon\u00e1van\u00edm pr\u00e1c svojich zamestnancov. Ako to prebieha? Na vyhodnotenie situ\u00e1cie sl\u00fa\u017ei pravdiv\u00e9 zodpovedanie jednoduch\u00fdch ot\u00e1zok, napr\u00edklad:<\/p>\r\n\r\n\r\n\r\n<ul class=\"wp-block-list\">\r\n<li>Existuje objekt\u00edvne nebezpe\u010denstvo \u00farazu pri vykon\u00e1van\u00ed pracovn\u00fdch \u00faloh?<\/li>\r\n<li>Hroz\u00ed zamestnancovi mimoriadne opotrebenie pracovn\u00e9ho odevu pri vykon\u00e1van\u00ed svojej pr\u00e1ce?\u00a0\u00a0<\/li>\r\n<\/ul>\r\n\r\n\r\n\r\n<p>Ot\u00e1zky s\u00favisia v\u017edy s konkr\u00e9tnou pr\u00e1cou zamestnanca. Zamestn\u00e1vate\u013e n\u00e1sledne mus\u00ed <strong>identifikova\u0165 v\u0161etky rizik\u00e1<\/strong>, ktor\u00e9 nemo\u017eno vyl\u00fa\u010di\u0165 a rozhodne o pridelen\u00ed OOPP. Pracovn\u00fd odev a v\u0161etky ostatn\u00e9 OOPP je zamestn\u00e1vate\u013e povinn\u00fd poskytn\u00fa\u0165 zamestnancovi <strong>bezplatne<\/strong>. Zamestn\u00e1vate\u013e v \u017eiadnom pr\u00edpade nem\u00f4\u017ee svojmu zamestnancovi tieto pom\u00f4cky <strong>pred\u00e1va\u0165 alebo strh\u00e1va\u0165 zo mzdy<\/strong>. O poskytnut\u00fdch pracovn\u00fdch odevoch a prostriedkoch pracovnej ochrany zamestn\u00e1vate\u013e z\u00e1rove\u0148 vedie presn\u00fa evidenciu.<\/p>\r\n\r\n\r\n\r\n<h4 class=\"wp-block-heading\">Ako \u010dasto m\u00e1 zamestnanec n\u00e1rok na OOPP?<\/h4>\r\n\r\n\r\n\r\n<p>V pr\u00edslu\u0161nom <a href=\"https:\/\/www.uvzsr.sk\/docs\/leg\/395_2006.pdf\" rel=\"nofollow noopener\" target=\"_blank\">Nariaden\u00ed vl\u00e1dy<\/a> je vymedzen\u00e9 aj to, ako dlho m\u00f4\u017eete pracovn\u00fd odev resp. OOPP zamestnanec pou\u017e\u00edva\u0165. Paragraf 6 hovor\u00ed, \u017ee zamestn\u00e1vate\u013e je povinn\u00fd <strong>na z\u00e1klade z\u00e1va\u017enosti nebezpe\u010denstva a d\u013a\u017eky jeho p\u00f4sobenia, charakteru pr\u00e1ce ur\u010di\u0165 presn\u00e9 podmienky pou\u017e\u00edvania OOPP,<\/strong> najm\u00e4 dobu ich pou\u017e\u00edvania.\u00a0<\/p>\r\n\r\n\r\n\r\n<p>To znamen\u00e1, \u017ee ak zamestn\u00e1vate\u013e vyhodnot\u00ed, \u017ee pracovn\u00fd odev zamestnanca u\u017e nie je z d\u00f4vodu opotrebenia alebo po\u0161kodenia vhodn\u00fd na pr\u00e1cu, automaticky mu mus\u00ed poskytn\u00fa\u0165 n\u00e1hradn\u00fd alebo opravi\u0165 ten s\u00fa\u010dasn\u00fd. Zamestn\u00e1vate\u013e zabezpe\u010duje udr\u017eiavanie OOPP najm\u00e4 pravideln\u00fdm <strong>\u010disten\u00edm, opravou a v\u00fdmenou.\u00a0<\/strong><\/p>\r\n\r\n\r\n\r\n<p>Pracovn\u00fd odev by sa mal takisto meni\u0165 <strong>v z\u00e1vislosti od ro\u010dn\u00e9ho obdobia.<\/strong> V lete by mal by\u0165 materi\u00e1l <strong>tenk\u00fd, \u013eahk\u00fd a priedu\u0161n\u00fd.<\/strong> V zime mus\u00ed odev a obuv zamestnancov <strong>ochr\u00e1ni\u0165 pred zimou a snehom.<\/strong> Ka\u017ed\u00fd zamestnanec mus\u00ed OOPP pou\u017e\u00edva\u0165 v\u017edy, ke\u010f si to povaha jeho pr\u00e1ce vy\u017eaduje.
